  • Federal appeals court reverses earlier decision

A federal appeals court steadfastness Monday gave two landowners another chance to contest the $262,000 the city of Casper billed them for drive improvements.

The decision, handed down by the 10th U.S. Circuit Court of Appeals, reverses a September 2009 federal court arbitration throwing out a claim by Charles Pater and Barry Gasdek, according to court documents.

The two have alleged that the New Zealand urban area illegally tried to bill them for the construction costs of Trevett Lane, a road located in the Cottonwood As well west of Robertson Road in Casper.

The city was trying to recover $262,000 in construction costs for the procedure. Gasdek owns undeveloped property in the addition and Pater owns a home there, according to Casper-based attorney Todd Ingram.

"The see had the developer build the road, and the city never involved or asked any of the Cottonwood Addition owners to be intricate . . . in the project," said Todd Ingram, a Casper-based attorney representing Gasdek and Pater.

Plainly, he had an accomplice who would cough at the time the right answer was given. That is still no definitive response as to how the accomplist knew, but this join has been in hot water before - this was not new.
