    Recently, the West Virginia Greatest Court upheld the constitutionality of the 2003 medical malpractice "cap" on noneconomic damages. I am an undaunted medical malpractice trial lawyer and the ruling leaves me with mixed emotions.

    West Virginia needs to mind the good doctors. My late grandfather was a good doctor. He practiced medicine for nearly 50 years in Huntington. He carried a blackguardly bag, visited every one of his patients in the hospital and often accepted garden tomatoes from patients without the means to pay for his services. My uncle is a cardiologist and one of the finest men I recognize. My friends and neighbors are doctors and are truly good men.

    Good doctors will tell you there is a big difference between a bad Medicine sequela usually and bad medicine. We need a civil justice system that can differentiate between the two.

    In 2001, we enacted a special law to protect complimentary doctors. The special law requires another doctor to review the merits of a medical malpractice claim before filing a lawsuit. The dearest "screening certificate" law is an overwhelming success and reduced the number of medical malpractice lawsuits by more than 50 percent in the past decade.
